L’intervention en Libye et la violation de la légalité internationale : un retour à la pseudo « morale internationale » du 19ème siècle - Investig’Action

See on Scoop.it - Saif al Islam

See on Scoop.it - Saif al Islam

Libya Election Loser Mohammed Sawan’s Dangerous Words
See on Scoop.it - Saif al Islam

The calm political dialogue that followed the historic first vote since the fall of Gaddafi is over, with the Muslim Brotherhood leader who lost making ‘alarming comments’ about winner Mahmoud Jibril.

(…)

“But for others the past remains the focus. Revolution will be finished only when all vestiges of the Gaddafi regime and anyone associated with it have gone. “We should put on trial all the buggers, everyone who was involved with Gaddafi, even if it takes 10 years,” says Abdul Rahman El Mansouri, a former political exile and Muslim Brotherhood supporter.

It will not be easy to persuade militias to disband with payback sentiments like those. Some militias are still hell-bent on wreaking revenge on regime loyalists or old tribal and ethnic foes, putting right, from their point of view, the wrongs of the past, some stretching back decades. Or as Abu Bakr, a militia commander from the hardscrabble mountain town of Zintan, puts it: “There were winners and losers in the war. How come politicians are saying, ‘Now we are equal’?” We won; they lost. Hard luck. We can do what we want with them now.” … “

Washington's Man in Tripoli : Indybay
See on Scoop.it - Saif al Islam

“Mahmoud Jabril takes over as Libya’s new leader. He heads its puppet government.

Sham elections installed him. The process was farcical. Illusion substituted for reality. Obama called his ascension “another milestone in the country’s transition to democracy.”

EU leaders hailed “Libya’s first free elections.” They called them the “dawn of a new era.” Scoundrel media acclaimed the end of the Gaddafi nightmare.

A democratic facade masks New World Order neoliberal fundamentalism. Its holy trinity is eliminating public services, predatory capitalism writ large, and repression enforcing the message to non-believers.

Libya gives Washington another beachhead for greater African adventurism. Unspeakable crimes of war and against humanity were committed establishing it.

Jabril’s now its main man. He got his marching orders. He’s expected to deliver. Otherwise another pro-Western hack will replace him.

Freedom is nowhere in sight. It’s true everywhere Washington runs things. Inside the bubble, it’s paradise. Outside it’s dystopian hell. It features exploitation and denial of fundamental rights.

Everything Gaddafi gave is gone. The Libya that was no longer exists. A blank slate replaced it. Carving up its corpse for profit is policy.  … “

IMPOSSIBLE TO GO ON HID IT: IPS – Human Rights Worse After Gaddafi | #Libya #Saif #Torture
See on Scoop.it - Saif al Islam

Human Rights Worse After Gaddafi -

“The human rights situation in Libya now is far worse than under the late dictator Muammar Gaddafi,” Nasser al-Hawary, researcher with the Libyan Observatory for Human Rights tells IPS.

Hawary showed IPS testimonies from families whose loved ones have been beaten to death in the custody of the many militias that continue to control vast swathes of Libya.

“At least 20 people have been beaten to death in militia custody since the revolution, and this is a conservative figure. The real figure is probably far higher,” says Hawary, pointing to photos of bloodied bodies accompanying the testimonies. .. “

Libya: As Deadline Passes, Militias Still Hold Thousands | Human Rights Watch
See on Scoop.it - Saif al Islam

“(Tripoli) – The Libyan government should take immediate steps to assume custody of all of the roughly 5,000 detainees still held by militias. The Defense and Interior Ministries have not been able to rein in the well-armed militias or to convince them to hand over detainees to Libyan authorities. These detainees and the approximately 4,000 others already in state custody should be granted their full due process rights, Human Rights Watch said.

Under Law 38 on some special procedures, passed on May 2, 2012, the Interior and Defense Ministries were required to refer all “supporters of the former regime” currently detained by militias, if there is sufficient evidence against them, to the competent judicial authorities by July 12.

“Across Libya, thousands of detainees still languish in prisons run by militias, without a formal charge and without any prospect for legal review,” said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch. “Despite months of cajoling the militias, the transitional authorities missed the deadline and failed to gain control over approximately 5,000 people still held arbitrarily by armed groups, some subjected to severe torture.” … “

As also stated in this article, these common denominators have an additional component, which is the containment of Chinese access to resources, commerce, transportation and the development of joint venture based, interventionist partnerships.(ibid.)

Where it went wrong for Libya's Islamists - The National
See on Scoop.it - Saif al Islam

«… “The Islamists didn’t win, and they won’t win. We consider them extremists,” said one woman with two small children who gave her first name, Amal. “I would think of immigration. They will control the way I dress, I won’t be able to go out to the shops freely or sit with my friends.”

Dressed in a headscarf and long coat in the sweltering heat, Amal - and her husband Lotfi - are Muslim but were worried that Libya might become “like Afghanistan under the Taliban” if Islamist parties had won.

Although Libyans are almost universally conservative Sunnis, the idea of a religious politicians is irksome to some. “We are all Muslims,” said Ghaith Al Juweili, a lawyer emerging from the same seafront mosque. “When they say they’re an Islamic party, it’s like they are questioning our Islam.” … »

In that vein, I urge the Transitional National Council to adopt the following two policies.

In Tripoli’s post-revolution prisons, there is no rule of law | The Observers
See on Scoop.it - Can’t Stop

Members of Forsan’s militia argue that because the police lack any authority, the town would spiral into chaos without them. Although probably correct, it is also true that militias often have too much power, as illustrated by the examples above. With no apparent system of checks and balances to guarantee a citizen’s rights, anyone could be arrested at any time. The militias are in charge of arrests, investigations and the decision to hold someone in custody or not. Such power could easily be corrupted to favour the wealthy, influential or well-connected.

Libyan Elections, Demographics & ‘News Media’ Coverage
The Libyan elections: what did you see on TV, happy smiling faces, unbelievable statements about ‘strange feelings’, even ‘freedom’, and other words no westerner would utter where elections are seen as a waste of time, a boring task, even a futile one?
In the current set up in Libya, the ruling thugs are judge, jury and executioner. There is no independent verification of their claimed figures for registrations to vote, nor of participation in the elections. On the contrary, facts on the ground and testimony of residents in Libya, is that an obvious majority of people totally boycotted the elections which they see as a sham.

So, who actually voted, and why? For this, we need to take a look at the current demographics of Libya.

Libya Is Still Riven by Violence as Loyalists and Rebels Alike Keep Killing - #Libya #Gaddafi #Saif #NTC
See on Scoop.it - Saif al Islam

Nine months after the ouster of Muammar Gaddafi, factions on both sides of the conflict continue to hunt down their enemies, especially in the loyalist stronghold of Sirte, writes Jamie Dettmer.

 …

Standing near a villa Gaddafi may have hidden in, Nouri Alworfally, 30, has no doubt the killers are militiamen from the hardcore anti-Gaddafi town of Misrata two hours away. “They think this is Gaddafi’s city. They think anyone from Sirte is a Gaddafi person,” he says, drawing on a cigarette. He tells of young men being snatched by militiamen and taken to Misrata. “I am afraid to leave the city and go to Tripoli. You have to pass through checkpoints and the moment the Misratans see you are from Sirte, they abuse you,” he says. He denies that people in District 2 knew that Gaddafi was hiding among them last October, but he makes no pretense of his dislike of the uprising. And he’s not alone. Sirte’s turnout in last weekend’s landmark elections was one of the lowest in Libya, just 53 percent.

“Working on human rights here is very scary,” says activist Alsbaey. He too seems reluctant to talk, explaining apologetically there are dangers from both pro- and anti-Gaddafi loyalists. “There’s a security void here. There is vengeance.”

” … I preferred not to talk so that I don’t ruin my lawyers defense which until now I have no idea what it is because until now I didn’t get to meet him, and since the day I was caught I met with the previous justice minister who is head of the human rights council and asked him that who ever comes to investigate with me comes from the government itself but since that day I was moved from militia to militia to militia interrogated by child after child after child and once I was interrogated for seven hours -  a man in my medical situation and gone through what I’ve gone through.

And even my court date I was told about it after it was announced on TV and at that time it had been seven months that I was in prison and I haven’t met my lawyer. Why was it I was interrogated without my lawyer? Even until now I’ve yet to meet my lawyer. And when I was interrogated I was told that you couldn’t find a thing on me so where are you coming up with all of these accusations which I am completely innocent from and why is it from EVERY position and ministry I’ve held the only witness you brought against me was someone I’ve fired for inappropriate behaviour years ago. … “

Is Libya The Next Somalia? By Thomas C. Mountain
See on Scoop.it - Saif al Islam

“Libya seems well on its way to becoming the next Somalia, with much of the country already ruled by tribal/clan based armed militias. As was the case in Somalia, Libya is in the process of separation, with the eastern, oil rich, Cyrenica region having issued a de facto declaration of independence.

Tripoli, the capital of Libya, seems to be headed in the direction of where Mogadishu, the capital of Somalia was 20 years ago, with various well armed militias from outside the city taking up residence and clashing over territory and the spoils of power.

The only real modern national government Libya ever knew was under Gaddafi just as the only modern government Somalia ever knew was under Siad Barre. … “
